Description of Legal Services
Collective Bargaining – The firm represents labor organizations/unions and employers throughout the entire collective bargaining process, including if an impasse in negotiations is reached requiring representation at a special magistrate impasse hearing, a legislative body impasse hearing, and binding interest arbitration.
Unfair Labor Practice Charges – The firm represents both labor organizations, employees, and employers in unfair labor practice charges in front of the State of Florida Public Employees Relations Commission and the National Labor Relations Board on matters, including but not limited to, unilateral change charges, breach of duty of fair representation charges, retaliation charges, direct dealing charges, and failure to negotiate in good faith charges.
Representation Petitions – The firm represents labor organizations and employees in representation petitions, unit clarification petitions, and unit modification petitions in front of the State of Florida Public Employees Relations Commission, the National Labor Relations Board, and the Federal Labor Relations Authority.
Contract Grievances – The firm represents labor organizations, employees, and employers in contract interpretation grievances through the steps of the grievance procedure, including arbitration hearings pursuant to the American Arbitration Association and Federal Mediation and Conciliation Service.
Employee Discipline – The firm represents labor organizations, employees, and employers in employee disciplinary matters appealed through the grievance procedure to arbitration, to personnel/civil service board, or pursuant to the Administrative Procedures Act (APA) under Chapter 120 of the Florida Statutes.
Professional License – The firm represents employees in professional license proceedings held pursuant to Administrative Procedures Act (APA) under Chapter 120 of the Florida Statutes.
Unemployment Compensation – The firm represents employers and employees in unemployment compensation hearings.
Employment Contracts – The firm prepares individual employment contracts for employees and employers and represents its clients in breach of contract claims relating to the enforcement of individual employment contracts.
Whistleblower – The firm represents employees and employers in Whistleblower claims filed in state and federal court.
Family and Medical Leave Act – The firm represents employees and employers in claims brought in federal court under the Family Medical Leave Act 0(FMLA) and American with Disabilities Act (ADA).
Wage and Hour – The firm represents employees and employers in the filing of Wage and Hour Claims under the Fair Labor Standards Act (FLSA), including but not limited to, minimum wage claims and unpaid overtime claims.
Employment Discrimination – The firm represents employees and employers in employment discrimination claims, including but not limited to, age, gender, race, disability, and national origin discrimination claims.
Personal Injury – The firm assists in individuals in obtaining compensation for injuries caused by the negligence of others, to include lost wages, medical expenses, property loss, pain and suffering, and mental anguish. This also includes representation in third-party insurance claims against insurance companies in motor vehicle accidents and other causes of accidents where a third party insured’s negligence caused the injuries.
